Thanks to Utah’s HB 82, the rules for basement apartments have opened up significantly. In cities like Herriman, Riverton, and West Valley City, turning your basement into a long-term rental (30+ days) is now a "permitted use" for owner-occupied homes.
The state has capped parking requirements, meaning most cities can only ask for one additional off-street parking spot for your tenant. This is a game-changer for homeowners in tighter spots like Sandy or Salt Lake City proper.
Basement Finishing vs. Basement Apartment
There is a big difference between a "finished basement" and a "legal ADU."
Basement Finishing: Adding a bedroom, a bathroom, and a theater room. This adds comfort and home value.
IADU (Basement Apartment): This triggers specific code upgrades, including fire separation (fire-rated drywall on ceilings), interconnected smoke alarms, and often a separate entrance.
The Technical Non-Negotiables

Egress Windows: These are non-negotiable for any basement bedroom. They must meet specific size requirements (usually 5.7 sq ft of openable area) to allow for emergency exit.
